Frequently Asked Questions about Wills, Trusts, Estates and Probate

SHOULD I USE A LIVING TRUST TO AVOID PROBATE?  A Living Trust can be a useful tool to avoid probate when you have minor beneficiaries, real estate in other states or if your beneficiaries have spendthrift or addiction issues.  However, it is more complicated than the simple tools described in our blogs.  If you are not sure if a living trust is the right tool for you, ask any of the attorneys at Olsen Law Group.

WHAT IF I ALREADY HAVE A LIVING TRUST?  Some people have decided to replace their Living Trust with the simple tools described in our blogs..

I HAVE A LIVING TRUST, BUT MY HOME IS NOT OWNED BY MY TRUST.  The attorney who prepared your trust may not have put your home into your trust.  In conjunction with your trust, we recommend an Enhanced Life Estate Deed to avoid probate on your home.

I HAVE JOINT ACCOUNTS WITH MY SPOUSE.  DO I STILL NEED TO MAKE THEM POD (PAYABLE ON DEATH)?  The answer is “yes” so that the account will still avoid probate if you both die in a common accident.

WHAT SHOULD I DO NOW?  Olsen Law Group offers a free initial consultation regarding the preparation of your estate planning documents.  We can do that initial consultation by phone, zoom or in person (your choice.)  We also offer Saturday appointments.  Call the Olsen Law Group at (407) 423-5561 to schedule your free estate planning consultation.
